Speaking of “pot”:

This sounds similar to a “knock and talk” program. Under that program, police officers knock on the doors of residences suspected of containing grow operations. After they identify themselves as officers, they ask if they can enter and look around. Many occupants, notwithstanding the presence of cultivating marijuana, freely— and unwisely— grant their consent. When the search is later challenged, courts have deemed them to be constitutional on the grounds that the Fourth Amendment was voluntarily waived. But, sometimes evidence obtained from those searches can be suppressed on the grounds that, as a result of police actions, consent was not freely and voluntarily given.
