- (Toledo Blade)
RESNICK, Melvin L. died Thursday evening, September 11, 2008, in his home with his family at his side. He was born in New York City on June 27, 1927, to Jack and Ida Resnick. In 1932, the family moved to Toledo and established a laundry and dry cleaning company to be known as the LaSalle Cleaners in downtown Toledo. Mel did not attend his graduation from Devilbiss, instead he joined the Navy and participated in World War II on a submarine and later on a PT boat. Upon returning home to Toledo he became a student at the Ohio State Law School graduating in 1952. He joined the law firm of Gorman and Barone. In 1961 he became an Assistant Lucas County Prosecutor where he tried hundreds of felony cases. In 1970, a death penalty case, State vs. Crapton was accepted in the United States Supreme Court on the issues of bifurcated trial in death penalty cases and the issue of lack of adequate guide lines for jury determination. He successfully won the Crapton case which was later altered creating the bifurcation of guilt and innocence and creation of mitigating circumstances guide lines for the jury to determine when the death penalty was proper. Judge Mel, as he was fondly called by all, was instrumental in assisting young lawyers in perfecting their skills. He did this during his years as Assistant Prosecutor and continued the practice as a Judge. Judge Mel was first elected to the Lucas County Common Pleas Court in 1976 and remained there until 1990 when he was appointed to the Sixth District Court of Appeals. While he was known for being a tough judge he possessed great compassion for all, whether they be victim or defendant One very vivid example of this compassionate understanding concerned a young man whom he was obligated to sentence to prison. He knew what the young man would face in jail and was direct in informing him. He continued the sentencing and advised him to work out and strengthen himself so that he would be able to deal with what faced him in prison. Judge Mel was the recipient of many awards and honors. A few of which were the Ohio State College of Law Alumni Association presented him with the Distinguished Alumni in 1998. Recognizing his contribution of helping young attorneys he was awarded the Order of the heel in 1982. Upon retirement he received recognition for 50 years of dedicated service to the Bench and Bar in 2003. In 2008 he was recognized on Law Day with the Distinguished Toledo Lawyer Award by the Alumni. He was married for 38 years to former Justice Alice Robie Resnick. He is the father of three children, Kenneth (Elisabeth) Vice President and General Counsel of GE Oil and Gas in Florence, Italy, Gary (Rachel) owner of LaSalle Cleaners and Cynthia Hill of California. Also surviving are brother, Larry (Susan) Resnick of California; 6 grandchildren, Sarah (Tim) Schaffer, Mark Resnick, Nathan Resnick, Stephanie Resnick, Valerie Resnick and Jennifer Hill. At his request there will be no visitation and services are private. Arrangements are being handled by Robert H. Wick/ Wisniewski Funeral Home (419-535-5840). Tributes can be made to the Kidney Foundation of Northwest Ohio, Hospice of Northwest Ohio, the charity of the donor's choice, or the University of Toledo Foundation for the Judge Melvin L. Resnick Law School Fund. Send checks to UT College of Law Office of the Dean, 2801 W. Bancroft, Toledo, OH 43606-3390.
